What We Do:
EtikX provides facilities to make online sales by Event Organisers. By using or visiting the EtikX website, you agree to be bound by the these terms. EtikX reserves the right to change these Terms at any time and without notice. If you violate these Terms, EtikX may terminate your use of the website and take appropriate legal action.
The site provides Event Organisers with the ability to market the content of your events. EtikX is not liable or responsible for any user content. If you feel any content is in place without authority, please contact us at Etikx.co.uk
The site offers customers the ability to purchase tickets, or registration, for the specific events listed.
Unauthorised use of the site, including ticket sales or fraudulent listings, will be the subject of legal action. If you as Event Organiser only use EtikX for administration of other reservations, EtikX will make a charge of £50 per month for use of our facilities, and may delete all data from your account.
Site users may be held liable for any illegal or prohibited content they provide. If you discover this kind of material on the site, please notify us by email at EtikX.co.uk and we will take any appropriate action.
As Event Organiser, it is your responsibility to provide true and accurate information. Should you not do so EtikX has the right to terminate your account.
You acknowledge and agree that all content and information on the site is protected by proprietary rights and laws. The content and software on this website is the property of EtikX, and where copyright is required appropriate reference is given.
Third party sites:
The site may contain links to other websites maintained by third parties. These links are provided solely as a convenience and do not imply endorsement of, or association with the party by Etikx.
Modifications to this Agreement:
Etikx reserves the right to change or modify any of the terms and conditions contained in this agreement at any time. You agree that it is your responsibility to review the site and terms from time to time. Your continued use of the site after any modifications to this agreement will constitute acknowledgment of the modified terms and agreement to be bound by the modified terms.
Termination of Use:
Etikx shall have the right to immediately terminate or suspend, at it's discretion, your access to all or part of the site with or without notice for any reason.
Disclaimer of Warranty:
You expressly agree that use of the site is at your sole risk and discretion. Etikx reserves the right to change the site content and information at any time without notice.
Limitation of Liability:
In no event shall Etikx be liable for any indirect, incidental, special, puntitive damages or consequential damages of any kind, or any damages whatsoever arising out of, or related to your use of the site.
Any disputes arising out of or related to these terms or any use by you of the site, shall be governed by the laws of the United Kingdom.
You shall indemnify EtikX, and hold harmless EtikX against any and all losses arising from any breach of the agreement by the Event Organiser or the acts or omissions of the Event Organiser.
Etikx allows Event Organisers to collect revenue directly at the point of sale.
EtikX may collect revenue directly at the point of sale. In this case ticket sales revenue made online, will be retained by Etikx, and the income, less agreed fees, will be transferred to the Event Organiser within 14 days of the event conclusion.
In either case all ticket, and registration revenue will be collected through Paypal. Where Event Organisers have other methods of payment, that information will be included within the event details.
Etikx will not process card details obtained by the Event Organiser.
Collection of Ticket Sales:
Where the Event Organiser require EtikX to collect the price the Event Organiser has provided for each ticket, EtikX will retain the full amount of the ticket sales within our own accounting system as a separate item.
Where the Event Organiser collects the revenue directly at the point of sale, that revenue is retained by the Event Organiser.
In either case, payment details will be made clear to the purchaser at the time of purchase, and also on the event listing. This becomes important should disputes arise.
Transfer of Funds:
Where EtikX collects payments at the request of the Event Organiser, on conclusion of the event, all funds following the deduction of our agreed charges, and any refunds to be made to customers, will be transferred to the Event Organiser by electronic transfer within 14 days.
If an event is cancelled, or there are significant changes made, customers may be refunded from the total income of the event, and EtikX may retain sufficient funds in order to make those refunds. Any cancellation may delay the transfer of funds whilst confirmation and clarification is sought.
All net income will be paid into the bank account specified by the Event Organiser, whose responsibility it is to ensure those details are accurate. No liability is accepted if those details are incorrect.
Where the Event Organiser collects revenue there will be no transfer of funds.
Where EtikX collects ticket / registration sales, A chargeback occurs when a customer disputes a charge on their payment with Paypal. The service provider may request information, and we will supply all relevant information in relation to the transaction. Funds will be held in reserve for any disputed payments until the matter is resolved. EtikX reserves the right to make an admin charge for any disputes that do occur. Should the dispute be upheld in favour of the customer, the amount will be deducted from the amount due to the Event Organiser, and the tickets cancelled.
Where the Event Organiser collects revenue disputes will be handled by the Event Organiser.
Paypal Payment Processing:
Event Organisers who choose to collect payment directly to their own Paypal account will agree to:
- Set up and manage their own merchant service through Paypal (for information please go to www.paypal.com)
- Be responsible for the payment of Paypal processing fees.
- Accept responsibility for refunds and disputes.
- Accept responsibility for chargebacks.
- Accepts responsibility for compliance with PCI DSS standards and data protection and the safe handling of payment cards and confidential information.
- indemnify EtikX against any customer claims.
- Agree to pay our invoice for the Administration Fee per ticket sold.
- Remain responsible for their own VAT Payments
Ticket Sales Management:
The ticket sales service offered by Etikx, is available free to Event Organisers, and it is vital for Event Organisers to understand that once tickets are allocated for sale, they must not be offered for sale elsewhere, as this may lead to overbooking, customer complaints and chargebacks. EtikX will not be responsible for ticket sales made where there are no tickets available for that event . It is vital that all the tickets offered for sale are available until they are sold through our website.
Fees & Charges:
Our normal Administration Fee is 39p per ticket sold. This amount will be taken from the ticket price quoted to us by the Event Organiser. It will NOT be added to the ticket price quoted by the event organiser.
If the Event Organiser uses their own Paypal account for the sale, there are no further charges from us.
If an Event Organiser uses our Paypal account, we will make a further charge of 20p per ticket plus 5% of the total sale.
The Event Organiser will be invoiced for the total fee on conclusion of the event, and this amount is due on receipt of the invoice, and must be paid electronically to the details provided on the invoice. Where we collect customer payment, our Administration fee and Paypal charges will be deducted from the amount due to the Event Organiser.
Event Organisers must not alter, edit or delete any entries in their bookings admin area, which may result in the actual number of ticket sales being altered. If such action is taken by an Event Organiser we will make a charge of the Administration Fee, plus Paypal charges and assume that all allocated tickets have been sold at the maximum price listed.
Event Organisers MUST list the total price for the ticket as one amount. Our charges will be taken from the ticket sale price. No extra charges are levied on the customer for any reason.
Free events are not charged an Administration Fee.
Tickets purchased outside the allocation provided to EtikX are not charged an Administration Fee, however any tickets removed from the allocation given to us by the Event Organiser, may be charged an Administration Fee.
Separate arrangements will be made for specific registration facilities requested by an Event Organiser. The costs involved will be agreed between EtikX and the Event Organiser before any registration process is made live in the site. Please contact EtikX.co.uk for further details.
Ticket Delivery Fees:
All tickets are delivered electronically, and no fee is charged.
Event Listing Process & Responsibilities:
All event information is listed by the Event Organiser, and no responsibility is accepted by EtikX if that information is inaccurate. Any enquiries should be addressed to the Event Organiser.
We will terminate the privileges of any user who uses this site to unlawfully transmit copyrighted material
EtikX offers options for customers to purchase tickets (fees and charges apply). The customer can purchase tickets via the Event Organisers EtikX URL
The purchaser will then be asked to select the method of payment, and having entered, and submit payment details, the EtikX system will charge the card issuer the appropriate amount. On completion of the transaction, the purchaser will be sent confirmation of purchase by email.
Confirmation of Orders:
Order confirmation will take the form of a screen message at the end of the purchase process. This will be followed by an email to the customer containing details of the purchase, and a ticket purchase reference number, which acts as proof of payment and may be used by the Event Organiser as an entry ticket.
If a customer does not receive a confirmation email after making payment, it is their responsibility to confirm the purchase with the Event Organiser. Contact details are on the specific event page. EtikX will not be responsible for loss, if a customer assumes that an order was, or was not placed because they failed to receive confirmation.
Any ticket holder unable to present confirmation of purchase at the event and valid identification may be refused entry, and will not receive a refund.
Refunds & Exchanges:
Once purchased tickets cannot be exchanged or refunded by EtikX. The Event Organisers details are available on each ticket, and event listed on the website, and reference must be made with the Event Organiser for refunds or exchanges.
Cancelation of an Event
If an Event is cancelled by the Event Organiser, EtikX, or the Event Organiser, will refund the purchase price of the tickets. Event cancellation refunds incur a £1.00 handling fee per transaction.
Where we are made aware of a cancellation by the Event Organiser, EtikX will make refunds in line with the above policy.
Event is Postponed or there is a Change of Venue:
If an Event is moved from its advertised venue, or the date is changed, tickets already purchased may remain valid should the customer wish to attend the revised Event. If not, the Event Organiser will refund the purchase price. Event cancellation refunds incur a £1.00 handling fee per transaction. Customers must contact EtikX no later than 7 days after the events revised date.
Significant Change to Event:
Should the headline artist not appear, if the line up or content is substantially changed from that advertised at the time of purchase, then the Event Organiser may, on request, refund the purchase price of the tickets. Customers must contact the Event Organiser as soon as possible, and no later than 7 days after the event.
Refunds where the Event Organiser has collect payments direct:
Customers are required to contact the Event Organiser no later than 7 days after the event to request refunds due to a postponed event, change of venue or significant change to event or line up. EtikX will not be able to manage refunds after 7 days following the event. Refunds must be made by the Event Organiser and all enquiries will be directed to the Event Organiser.
In respect of any personal data (as defined in the Data Protection Act 1998) the Event Organiser is responsible to ensure that they comply with the Act.
All customer personal data by the sale of tickets will be owned jointly by EtikX and the Event Organiser and / or their Organisation and either party shall be entitled to use such customer data in whatever manner it sees fit.
EtikX is dedicated to providing a high quality and secure service to its customers. We are fully PCI DSS compliant and adhere to the EU Data Protection Directive.
Your Contact Details.
We will not pass your contact details on to another without your consent. Event details including, but not limited to, event organiser name, address, phone, email, event location will be available to view on the event and the ticket details sent to each customer.
We may also, from time to time, send you email communication concerning your events and event information, and by registering your details you agree to receive communication from us. Each email received will contain a link to unsubscribe which will be immediately honoured.
